Female member hiding facts. Now faces threat of losing seat.

 A woman member of the Municipality Mussoorie is accused of hiding in the name of husband and encroachment in the election affidavit. On this case, the High Court has also ordered the District Election Officer and Chief Secretary to settle within 60 days. This case has also been assigned to the Chief Secretary for a representation action. 

In the municipal council Mussoorie election of 2018, the nomination of Gita Kumani resident of Gita Sadan, Camelback Road, Mussoorie for the membership of the party was also nominated. There is allegation that in the affidavit nomination given by Geeta, she has mentioned in her name no encroachment and illegal construction. 

In the affidavit also, that the matter which is pending in the PP Act in the court, is under the name of Bharat Singh Kumani. It is clear in the Act that if the names of the members and the family are in possession of the municipality ownership or management, encroachment on the land, building, public road, track, drain, channel, then the candidate may be declared disqualified. 

In this case also, Geeta Kumani has accepted Bharat Singh’s name in the PP Act in the affidavit, but Bharat Singh is her husband, she has not mentioned this in the affidavit. 

In this case, the High Court ordered hearing on the petition of Kusari Singh Chauhan resident of Mussoorie on 10 April. It was mentioned clearly that in case the violation of section 13-D and 40 (b) of municipality Act 1916 is concerned then the concerned member may have to lose his post. 

Here, member Gita Kumani says that he does not know the order of the High Court. The affidavit he has given is correct. In this case I am ready for every kind of investigation. 

According to SDM Mussoorie Gopalram, giving false affidavits in the election is a crime. The candidate may be declared ineligible in the case of possession of the municipality or the punishment of the land. I have recently been deployed in Mussoorie. Therefore, the episode is not in the cognition.
